Terms and Conditions for purchasing E-Learning

This page lists the terms and conditions that are associated with our E-Learning courses.

Definitions

You refers to the person that is ordering an E-Learning course from Armstrong-Smith Consulting, the training specified in your order. The term Materials refers to the methodology, PDF documents, SQL scripts and course materials developed by Armstrong-Smith Consulting.

You agree with each of the following statements:

• You are not a citizen, national, or resident of, and are not under control of, the government of Cuba, Iran, Sudan, Libya, North Korea, Syria, nor any country to which the United States has prohibited export.
• You will not export or re-export the Materials, directly or indirectly, to the above mentioned countries nor to citizens, nationals or residents of those countries.
• You are not listed on the United States Department of Treasury lists of Specially Designated Nationals, Specially Designated Terrorists, and Specially Designated Narcotic Traffickers, nor are you listed on the United States Department of Commerce Table of Denial Orders.
• You will not export or re-export the Materials, directly or indirectly, to persons on the above mentioned lists.
• You will not use the Materials for, and will not allow the Materials to be used for, any purposes prohibited by United States law, including, without limitation, for the development, design, manufacture or production of nuclear, chemical or biological weapons of mass destruction.

EXPORT RESTRICTIONS You agree that U.S. export control laws and other applicable export and import laws govern your use of the Materials, including technical data. You agree that neither the Materials nor any direct product thereof will be exported, directly, or indirectly, in violation of these laws, or will be used for any purpose prohibited by these laws including, without limitation, nuclear, chemical, or biological weapons proliferation.

Armstrong-Smith Consulting accepts the following forms of payment:

Confirmation Process

Armstrong-Smith Consulting will send you a confirmation email for all E-Learning courses that you order.

Fees

E-Learning fees are payable to Armstrong-Smith Consulting at the time of orderng. We will send you a fully paid invoice when payment is confirmed.

Licenses

You or your organization are required to own the relevant Oracle licenses for the product that you will be trained upon.

Your acceptance of these terms and conditions releases Armstrong-Smith Consulting from any liability to Oracle Corporation should it later be determined that you did not own the required license at the time that you or one of your employees used the Armstrong-Smith Consulting Materials.

Ownership and Restrictions

Armstrong-Smith Consulting retains all ownership and intellectual property rights to the Materials that will be provided to you. The Materials provided to you may only be used by the company or individual that purchased the Materials. These Materials are designed to be used by a single user at a time. If your organization would like to have several people taking the course at once, please order the relevant number of multiple copies. This is not a named user license, but a concurrent user license.

Without express permission from Armstrong-Smith Consulting you may not:

• modify any of the Materials or remove any notice of Armstrong-Smith Consulting or Oracle’s proprietary rights;
• make the Materials available in any manner to any third party;
• cause or permit reverse engineering (unless required by law for interoperability), of the
  Armstrong-Smith Materials;
